Loyalty Program Terms of Service

PROGRAM: The Frameworth VIP Loyalty Rewards Program

Effective October 2022

Please read the terms and conditions outlined below. By taking part in the Frameworth VIP Loyalty Rewards Program in any capacity you agree to each of the rules, terms, and conditions contained herein. Loyalty members are responsible for monitoring the Terms of Service and FAQ for any changes to the Program Rules. Members’ continued participation in the Program will constitute your acceptance of any such changes to the Program Rules.

 

 

  1. Rewards Program

All Program benefits, tiered rewards, applicable discounts, and point earnings are subject to availability. Frameworth reserves the right to change, suspended or terminate the Program at any time without notice. Changes may include, but are not limited to: modifying the amount of purchases required to qualify for the various Rewards tiers, modifying the rewards available in each tier, changing the number of points earned per purchase, changing the value of points, changing the Rewards percentages, imposing additional restrictions, modifying the Terms of Service and/or FAQ, or terminating the Program, including outstanding Rewards points and Electronic Coupons without notice. Frameworth reserves the right to interpret Program rules and policies in its sole discretion and will be the final authority on point credits and Rewards qualifications.

Points do not hold any cash or monetary value, and may not be exchanged for any monetary considerations including, but not limited to discounts, gift certificates, cash, or credit outside of the terms of the program. Points, rewards, and accounts may not be bartered or sold.

  1. Redemption and Accumulation of Points

Points may only be earned or redeemed on select products determined at Frameworth’s sole discretion. Excluded products and purchases may include, but are not limited to: discounted items, Deal of the Day, Mystery Boxes, Corporate Partnership items or programs such as The Tragically Hip and Frameworth Auctions. Points which are applied or redeemed in error may be revoked at Frameworth’s sole discretion.

Purchases made through Frameworth Auctions are not eligible for the accumulation or redemption of points, tiered rewards, or any other Program benefit.

At Frameworth’s sole discretion, certain items may earn points, but may not have points redeemed against them.

  1. Minimum Purchase

In order to maintain membership within a reward tier, members must achieve a minimum annual spend in a rolling 365 day period. If the minimum spend is not achieved, the membership will be demoted by one tier. The minimum spend applies only to an order subtotal, and is only to applicable products as outlined in section 2.  The minimum spend required is outlined below:

  • Diamond for Life - $500
  • Diamond - $5,000
  • Platinum - $1,500
  • Gold - $750
  • Silver - $375
  • Bronze - $1

If no applicable purchases are made in accordance with section 2 over the course of a rolling 365 day term, all acquired points, tiered benefits, and rewards may be forfeited without any obligation or liability and may not be used, reinstated, or redeemed at a later date.

Points will be earned based on the subtotal purchase amount and shall not be awarded for any percentage paid towards taxes, shipping, duties, or any such value outside of an accepted order’s subtotal. Points are earned based on payment received.

 

  1. Account Cancellation

Frameworth may cancel a Member’s account, suspend or revoke loyalty benefits, suspend or revoke accumulated points at any time with immediate effect and without written notice, for any reason and in Frameworth’s sole discretion.

Reasons may include, but are in no way limited to: the manual closure of an account by the member; any violation of the terms of service or program guidelines whether written or, as determined in Frameworth’s sole discretion, is against the spirit of the program; payment is defaulted; the member or an associate acted in a manner which, in Frameworth’s sole discretion, has been deemed abusive, harmful, hostile, fraudulent, or inappropriate; or the participant acts in bad faith as determined in Frameworth’s sole discretion. Points and Rewards not used or redeemed prior to the closing or termination of an account, or the cessation of the Program, are forfeited without any obligation or liability, and may not be used, reinstated, or redeemed at a later date.

In the event of an account cancellation, the Member may not re-apply for membership or open a new account. Accounts which are found to be associated with the Member, as well as any accumulated points, rewards, tiers, or benefits, may be cancelled and forfeited upon discovery.

  1. Duplicate Accounts:

Loyalty Members may only maintain one Loyalty Account. Individuals, or individual corporations found with more than one loyalty account may be subject to the cancellation and forfeit of both accounts, including all accumulated points, rewards, and reward tiers without any obligation or liability from Frameworth.

  1. Transfer of Points or Accounts:

Accumulated points, tiered benefits, rewards, etc., do not constitute property of the member. Points, rewards, loyalty accounts, and tiered benefits may not be re-assigned or transferred under any circumstances. Points, rewards, and benefits earned by an individual may only be redeemed by that individual. In the event of a member’s death, Frameworth may, in its sole discretion, allow unredeemed points, rewards, loyalty accounts, tiered benefits, etc., to be transferred to a family member, or friend, provided they have an active membership in good standing.

  1. Personal Information:

Your personal profile must be valid and accurate, and must be maintained and updated in the event of any changes. Changes to personal information may not be accepted without supporting legal documentation. Changes made to personal information without proper supporting documentation may result in the closure of your account, and the forfeiture of any points, rewards, tiers, benefits, etc., without any obligation or liability from Frameworth. In the event that the provided personal information is found to be inconsistent or incorrect, Frameworth reserves the sole and unfettered right to close the Member’s accounts and revoke all acquired points, tiered benefits, and rewards without any obligation or liability.

 

  1. Taxes

Points, rewards, tiered benefits, and all other program entitlements may be subject to tax liability. Any tax liability, including disclosure, connected with the receipt or use of points, rewards, tiered benefits, other entitlements, etc., is the sole responsibility of the member.

 

  1. Acts, Errors, or Omissions

Frameworth is not responsible for:  (a) any loss or misdirection of, or delay in receiving, any Member application, correspondence, redemption requests, Awards or Member benefits; (b) theft or unauthorized redemption of Points or Awards or use of an Award; (c) any acts or omissions of third parties (including, without limitation, Participating Properties); or (d) any errors published in relation to the Loyalty Program, including, without limitation, any pricing or typographical errors, errors of description, errors regarding Participating Properties, and Loyalty Program affiliates, and errors in the crediting or debiting of Points from Member Accounts.  The Company reserves the right to correct, without notice, any errors, and at no obligation to the Member.

 

  1. Interpretation

All interpretations of program rules, benefits, terms of service, etc., are at Frameworth’s sole discretion, and Frameworth’s decision will be final. The continued participation in the program, or the maintenance of an account constitutes your acceptance of these terms and rules.
